There
are 49 sheriff courts throughout Scotland. The National Archives of Scotland (NAS)
accepts records from all of the sheriff courts according to agreed schedules.
The NAS normally accepts transmissions of sheriff court records after they
are 25 years old. Certain types of records may be transmitted earlier. Details
of the different record types can be found in the sheriff
court record schedule - Acrobat PDF 154KB, new window.
Records are
usually uplifted from the largest sheriff courts (Edinburgh and Glasgow) every
2 years, from smaller courts every 5 to 8 years, and from the smallest courts
every 10 years. To request a transmission of your records to the NAS,
contact the Court
and Legal Records Branch (CLRB), so that it can be discussed and agreed. Once
agreed in principle, sheriff clerks need to obtain the appropriate authority for
the transmission of their court's records. This must take the form of a letter
of authority from the Sheriff Principal, confirming the latest date(s) of the
records to be transmitted to the NAS. The letter should be sent to the NAS Sheriff
Court Officer. An online form of the letter
of authority - Acrobat PDF 68KB, new window.
Before a preparatory
visit from CLRB, sheriff clerks should complete a pre-inspection
survey form - Acrobat PDF 104KB, new window and e-mail
it to us. This will provide a helpful summary of the records for potential transmission.
We will use the information when we make our preparatory visit to the court. Failure
to complete the survey form could delay the transmission of records from your
court.
More detailed information on sheriff court records can be found
in the online catalogue
by searching under the name of the sheriff court. The NAS will normally
uplift inspected sheriff court records within 2 months of the completion of the
preparatory inspection.
